This GoMobile Service Agreement (“Agreement”) is entered into by and between GoDaddy.com, LLC, a Delaware limited liability company ("Go Daddy") and you, and is made effective as of the date of electronic acceptance. This Agreement sets forth the terms and conditions of your use of the GoMobile service (“Service”), and supplements Go Daddy’s Universal Terms of Service Agreement, which is incorporated herein by reference.
The terms “we”, “us” or “our” shall refer to Go Daddy. The terms “you” and “your” shall refer to any individual or entity who accepts this Agreement. Nothing in this Agreement shall be deemed to confer any third-party rights or benefits, except where specifically granted herein.
We may, in our sole and absolute discretion, change or modify this Agreement, and any policies or agreements which are incorporated herein, at any time and such changes or modifications shall be effective immediately upon posting to this Site. Your use of this Site or the Services after such changes or modifications shall constitute your acceptance of this Agreement as last revised. If you do not agree to be bound by this Agreement as last revised, do not continue to use this Site or the Services. We may occasionally notify you of changes or modifications to this Agreement by email. It is therefore very important that you keep your shopper account information current. We assume no liability or responsibility for your failure to receive an email notification if such failure results from an inaccurate email address.
GoMobile is a mobile application that allows you to build websites. The Service allows you to connect, create and share content through the creation of a mobile website. Please be aware that your wireless carrier may charge for data services these charges are your sole responsibility.
In order to use the Service you will need to register for an account. After registering you may begin to create websites through the Service. During registration we require that you provide us with your name, phone number, e-mail, and address. We may also require additional information from you if necessary. We may also allow you to login or share information with us via Facebook. We have the final discretion in granting accounts and reserve the right to reject users without explanation.
We reserve the right to alter, update, or remove the Service from your system at any time, or demand that you do so. We may conduct such modifications to the Service for security reasons, intellectual property or other legal reasons, or various other reasons at our discretion, and we are not required to explain such modifications.
By submitting any content to the Service you understand that this content may be viewable by the public. You agree that you are solely responsible for any content or information posted.
License. We make the Service available for downloading on our website or elsewhere, such as a third party store dedicated to the promotion and sale of apps. When you download the Service, you are given the right to download one copy of the Service at the price listed if any.
We grant you a non-commercial personal, non-exclusive, limited license to use our website and download the Service. You acknowledge that we maintain all right, title, and interest in the Service. This means you cannot sell the Service anywhere else, share your license to use the Service with anyone else, reverse engineer or otherwise attempt to copy the Service, or try and make money off of it without our express written permission. Even if we offer the Service for free, you must still abide by these provisions and not copy or otherwise use the Service in a manner prohibited by this section. You obtain no ownership rights when you purchase and download the Service, but are instead buying (or, in the case of a free download, being given) a license to install and use the Service within the confines of this Agreement.
Restrictions. You may not place any advertising or affiliate links on any websites created through the Service. We reserve the right to terminate your use of the Service immediately if we discover any unauthorized advertising posted on your website.
Geolocation Data. We may use the geolocation data transmitted from your mobile device's GPS unit, as well as information inferred from your mobile number (such as your area code), to determine your location and use if for the purpose of marketing and analyzing customer information. Specific location information will not be transmitted to any third parties, but will be known by Go Daddy. As a condition of our providing you with our Service, you consent to providing us with this information and our use of the information.
The titles and headings of this Agreement are for convenience and ease of reference only and shall not in any way be utilized to construe or interpret the agreement of the parties as otherwise set forth herein. Each covenant and agreement in this Agreement shall be construed for all purposes to be a separate and independent covenant or agreement. If a court of competent jurisdiction holds any provision (or portion of a provision) of this Agreement to be illegal, invalid, or otherwise unenforceable, the remaining provisions (or portions of provisions) of this Agreement shall not be affected thereby and shall be found to be valid and enforceable to the fullest extent permitted by law.
Capitalized terms used but not defined herein shall have the meanings ascribed to them in the Universal Terms of Service Agreement. In the event there is a conflict between the provisions of this Agreement and the provisions of the Universal Terms of Service Agreement, the provisions of this Agreement shall control.
Other than as described in this Policy, we will not give any information about you to others without your express permission.
In order to use the Service you will need to register for a GoMobile account. After registering you may begin to create websites through our App.
During registration we may collect personally identifiable information from you, including your name, telephone number, e-mail address, physical address, and unique device ID. We may also allow you to log in or share with us via Facebook. Please be aware that if you log in through Facebook we may collect any information about you that Facebook shares with us. We may collect other identifying information if necessary, including a credit card number.
Whenever you visit our Site or use our App, we may also collect non-identifying information from you, such as your IP address, your interactions with our Site or App, location, geolocation data, time zone, referring URL, browser, operating system, mobile phone information, cookie information, usage, data transferred and Internet Service Provider. This information alone cannot usually be used to identify you.
We receive and store any information you enter on our Site or App, or give us in any other way, including through email or other communications with our customer service department. If you contact us for support, we will keep an internal record of what support was given.
We use your information to contact you regarding functionality changes to our Service, Site, and App, new GoDaddy or GoMobile services, and special offers we think you'll find valuable. If you would rather not receive this information, please see the "Updating Your Information" section below on how to change your preferences.
We may also use your information to present a co-branded offer with our partners or affiliates. If we collect information from you in connection with a co-branded offer, it will be clear at the point of collection who is collecting the information and whose privacy statement applies.
We use information gathered about you from our Site and App statistics (for example, your IP address or device operating system) to help diagnose problems with our server, and to administer the Service. We also gather broad demographic information from this data to help us improve our Site and App and make your user experience more enjoyable. This is not linked to any personally identifiable information, except as necessary to prevent fraud or abuse on our system.
We may use geolocation data transmitted from your mobile device's GPS unit, as well as information inferred from your mobile number (such as your area code), to determine your location and use it for marketing and analysis purposes. Your specific location information will not be transmitted to any third parties, but will be known by us. As a condition of our providing you with the Service, you consent to provide us with your location information and our use of the information. If you do not want us to use your location for the purposes set forth above, please turn off location services on your device.
Our Site and App have security measures in place to protect against the loss, misuse or alteration of the information under our control. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. When you enter sensitive information we encrypt the transmission of that information using secure socket layer technology (SSL). No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.
We use emails to communicate with you, to confirm your activities on the Site and App, and to send information that you have requested. We also provide email links to allow you to contact us directly. We strive to promptly reply to your messages.
The information you send to us may be stored and used to improve the Site and App, or it may be reviewed and discarded.
We may at times provide information about you to third parties to provide various services on our behalf, such as processing payments, serving advertisements, conducting contests or surveys, performing analyses of our services or customer demographics, shipping of goods or services, and customer relationship management. We will only share information about you that is necessary for the third party to provide the requested service. These companies are prohibited from retaining, sharing, storing or using your personally identifiable information for any secondary purposes.

In the event that we use third party advertising companies to serve ads on our behalf, these companies may employ cookies and action tags (also known as single pixel GIF or web beacons) to measure advertising effectiveness. We use a tool called “Google Analytics” to collect information about use of our Site, such as how often users visit the Site, what pages they visit when they do so, and what other sites they used prior to coming to our Site. Google Analytics collects only the IP address assigned to you on the date you visit our Site, rather than your name or other identifying information.
Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit the Site. This cookie cannot be used by anyone but Google, Inc. The information generated by the cookie will be transmitted to and stored by Google on servers in the United States.
We use the information received from Google Analytics only to improve the Service. We do not combine the information collected through the use of Google Analytics with your personally identifiable information.
In order to provide certain services to you, we may on occasion supplement the personally identifiable information you submit to us with information from third party sources (e.g., information from our strategic partners, service providers, or the United States Postal Service). We do this to enhance our ability to serve you, to tailor our services to you, and to offer you opportunities to purchase products or services that we believe may be of interest to you.
From time-to-time, we may provide you with the opportunity to participate in contests or surveys. If you choose to participate, we may request certain personally identifiable information from you. Participation in these contests or surveys is completely voluntary and you therefore have a choice whether or not to disclose the requested information. The requested information typically includes contact information (such as name and address), and demographic information (such as zip code and age level - note that you must be 18 or above to enter). We use this information to notify contest winners and award prizes, to monitor site traffic, and to personalize the Site.
We may use a third party service provider to conduct these surveys or contests. When we do, that company will be prohibited from using our users' personally identifiable information for any other purpose. We will not share the personally identifiable information you provide through a contest or survey with other third parties unless we give you prior notice and choice.
We may display targeted offers to our customers based on the products currently owned by the customer. These offers will display as varying product banners. There is no personal or geolocation information collected within these product banners to build a profile about your activities or that is shared with third party advertising companies.
If a user elects to use our referral service to inform a friend about our Site or App, we ask the user for the friend's name and email address. We will automatically send the friend a one-time email inviting them to visit the Site or App. We store this information for the sole purpose of sending this one-time email. The friend may contact us at email@example.com to request the removal of this information from our database.
When your GoMobile account is cancelled (either voluntarily or involuntarily) all of your personally identifiable information is removed from GoMobile databases and servers after a short waiting period. This means that you will no longer be able to access any information you have previously provided to us. Please know that this action cannot be reverted.
You may alter, update or delete your account information or opt out of receiving communications from us and our partners at any time. We have the following options for changing, modifying, or deleting your account information or contact preferences.
We will respond to your request to alter, modify or delete your information within thirty (30) days.
Businesses subject to California Civil Code Section 1798.83 are required to disclose to their California customers, upon request, the identity of any third party to which the business has disclosed personal information for the third party’s direct marketing purposes, along with the type of personal information disclosed, within the previous calendar year.
As set forth above, we do not provide your information to third parties for their direct marketing purposes without your permission. However, if you are a California resident and would like to make such a request under Section 1798.83, please submit your request in writing to GoDaddy GoMobile , Attention: Privacy Team, 14455 North Hayden Road, Suite 219, Scottsdale, Arizona 85260, or firstname.lastname@example.org.
If you visit our Site or App from a country other than the country in which our servers are located, your communications with us may result in the transfer of your information across international boundaries. We may transfer your personal information to the United States, or to other governmental jurisdictions where the privacy laws may not be as protective as those in your jurisdiction, and process it there. By visiting our Site or App and communicating electronically with us, you consent to such transfers.
We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including without limitation subpoenas), to protect our property and rights or the property and rights of a third party, to protect the safety of the public or any person, or to prevent or stop activity we consider to be illegal or unethical.
To the extent we are legally permitted to do so, we will take reasonable steps to notify you in the event that we are required to provide your personal information to third parties as part of legal process.
If we make material changes to this Policy, we will notify you here, by email, or by means of a notice on our Site and App, at least thirty (30) days prior to the implementation of the changes.
